Liability Waiver & Program Policies

Assumption of Risk & Liability Waiver

I, the undersigned parent or legal guardian of the minor child named below (the "Participant"), acknowledge that participation in the Little Makos (Pups) youth baseball camp operated by Midwest Makos LLC (the "Organization"), including all practices, drills, scrimmages, and related activities, involves inherent risks that cannot be entirely eliminated regardless of the care taken to avoid them.

Acknowledged Risks

These inherent risks include, but are not limited to:

• Injury from thrown, batted, or pitched baseballs and other equipment
• Injuries resulting from running, sliding, diving, or sudden changes of direction
• Collisions with other participants, coaches, fences, bases, or other structures
• Sprains, fractures, concussions, muscle strains, and soft-tissue injuries
• Heat-related illness including heat exhaustion and heat stroke
• Insect bites, allergic reactions, and exposure to outdoor elements
• Injuries sustained during warm-up, conditioning, and cool-down activities
• Any other injuries arising from the nature of baseball and outdoor athletic activity

Voluntary Participation

I confirm that my child's participation in the Little Makos (Pups) program is entirely voluntary. I have read and understand the nature of the activities involved. I believe my child is physically fit and capable of participating in the program, and I have not been advised otherwise by a medical professional.

Release of Liability

In consideration of the Participant being permitted to take part in the Little Makos (Pups) program, I, on behalf of myself, my child, and our respective heirs, assigns, and personal representatives, do hereby release, discharge, and hold harmless Midwest Makos LLC, its owners, officers, coaches (including Devan Ahart, Nick Plummer, and Duncan Gillett), staff, volunteers, agents, and any facilities or property owners used for program activities (collectively, the "Released Parties") from any and all claims, demands, causes of action, losses, damages, or liabilities of any kind, whether known or unknown, arising from or related to the Participant's involvement in the program.

Medical Authorization

In the event that the Participant requires emergency medical attention during any program activity and I, the undersigned parent or legal guardian, cannot be reached in a timely manner, I hereby authorize the coaches, staff, and representatives of Midwest Makos LLC to:

• Administer basic first aid as needed and as they are trained to provide
• Contact emergency medical services (911) on behalf of my child
• Authorize emergency medical treatment, including transport to the nearest appropriate medical facility

I understand that any known allergies, medical conditions, medications, or special health considerations for my child should be disclosed on the registration form in the designated medical information field. It is my responsibility to keep this information current and to notify the coaching staff of any changes.

Photo & Video Release

I grant Midwest Makos LLC and its authorized representatives permission to photograph, video record, and otherwise capture the likeness of my child during their participation in the Little Makos (Pups) program, including practices, games, events, and related activities.

I further grant permission for the Organization to use such photographs, videos, and likenesses for the following purposes:

• Marketing and promotional materials (print and digital)
• Social media platforms (Instagram, Facebook, X/Twitter, TikTok, YouTube, etc.)
• The Midwest Makos and Little Makos websites
• Press releases, newsletters, and community outreach
• Internal training and program documentation

I waive any right to compensation for such use and acknowledge that images may be used without identifying my child by name unless separate written consent is provided.

Code of Conduct

The Little Makos (Pups) program is committed to providing a safe, positive, and encouraging environment for all participants. The following expectations apply to both players and their parents or guardians.

Player Expectations

• Treat all coaches, staff, teammates, and opponents with respect and good sportsmanship
• Follow the instructions of coaches and staff at all times during program activities
• Use all equipment properly and only as directed by coaching staff
• Refrain from bullying, taunting, or any form of harassment toward other participants
• Arrive on time, prepared, and ready to participate with a positive attitude
• Report any injury, discomfort, or safety concern to a coach immediately

Parent & Guardian Expectations

• Refrain from coaching, directing, or instructing players from the sidelines during sessions
• Treat all coaches, staff, other parents, and children with courtesy and respect
• Communicate concerns or questions directly to the coaching staff in a constructive manner
• Ensure your child arrives on time and is picked up promptly at the end of each session
• Support the coaching staff's decisions regarding drills, playing time, and player development
• Model positive sportsmanship and encourage effort over outcomes

Refund & Cancellation Policy

All fees are non-refundable once the program begins. By registering, you acknowledge and agree to this policy.

All cancellation requests must be submitted in writing to info@mwmakos.com. The following policies apply based on your selected pricing plan:

Weather Cancellations

Sessions cancelled due to inclement weather, unsafe field conditions, or other circumstances beyond the Organization's control will be rescheduled to an alternate date whenever possible. Weather-related cancellations are not eligible for individual session refunds. The coaching staff will notify registered families of any schedule changes as promptly as possible.

Privacy Policy & COPPA Compliance

Midwest Makos LLC is committed to protecting the privacy of the children enrolled in our programs and their families. In compliance with the Children's Online Privacy Protection Act (COPPA) and applicable state privacy laws, we adhere to the following data practices:

Data We Collect

• Parent/Guardian full name
• Parent/Guardian email address
• Parent/Guardian phone number
• Child's name
• Child's age and/or date of birth
• Emergency contact information
• Medical or allergy information as voluntarily disclosed

How We Use Your Data

All personal information collected is used solely for the purposes of program administration, including registration processing, session scheduling and communication, emergency contact procedures, and payment processing. We do not use children's personal data for marketing purposes.

Data Sharing & Security

We do not sell, trade, rent, or otherwise distribute your personal information or your child's personal information to any third parties for commercial purposes. Data may only be shared with payment processors as necessary to complete transactions, or as required by law. All personal data is stored securely using industry-standard encryption and access controls.

Your Rights

As a parent or guardian, you have the right to:

• Review the personal data we have collected about you and your child
• Request corrections to any inaccurate information
• Request deletion of all personal data at any time
• Withdraw consent for future data collection
